如果你不是很有钱，只不过是个所有财产少于三、四百万的普通老百姓；又心底坦荡，知道没有二奶的小孩或其他要钱不要命、八杆子打不着的亲戚来争遗产；就没有必要到律师那里去办遗嘱。自己写一张纸，说财产都留给谁谁，孩子都由谁谁监护，遗嘱的执行人是谁谁，放在电视机底下的抽屉里，就好了。还有千万不要忘了所有的投资、银行户头都要有 designated beneficiary. 这个designated beneficiary proceeds all wills. 如果实在找不到接收财产的人，把俺的名字放后面也行。:-)

Sorry, I made some mistake in the earlier comments. Having a will alone can not avoid going through probate and pay probate fee. It prevents the court from deciding for you, who has custody of your children and who receive your assets.

I like your blogs. But I do not agree with you on this one. The disadvantage of not having a will is that, when you die, your assets will go to probate, which will be held by court. You need to pay probate fee and your heirs will have no immediate access to your assets. If both husband and wife die in an accident. It would be a disaster for under age children. Who should take care of them? If your networth is less than $50,000, probably having a will or not is no big deal. It looks like you have considerable means, the protection of children's welfare and your hard-earned assets is important. You do not need to have a lawyer to write a will. Each state has its own laws about this. But in my state, you need to have 2 witnesses who are not beneficiaries to sign on the will. I suggest you read about estate planning to see what you need for assets protection and future assets transfer.
