想问大虾们一个问题。买房子时如果用 LG 一人的名字贷款还有房子的 owner 也只用 LG 的名字将来会有什么麻烦吗? LG 说之所以这样是因为我上班走不开,用一人的名字办贷款,还有房子 closing 时一个人去方便。 我是马大哈一个。不知道这会不会在将来有什么影响。

先说 Owner 中用夫妇其中一人名字在 title ,另一位是否有权益。这是由州法决定的。比如说你在 Community Property States ,夫妇在结婚后的财产,除自己单独继承或者单独获得的 gift 以外,双方共同有所有权。就是说,这个买入的物业,不管你的名字在不在 title 里面,你的权利都在里面。那些是 Community Property States ?一共九个: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington 。其它就是非 Community Property States. 也叫 Common law states 。具体的规定是由州法决定,各州并不一致。
贷款用其中一个人名字有如下问题: a) 一个人的 income 是否满足贷款的 income/debt 比例要求; b) 没有名字在上面的那位少了 credit 的累积效果的好处; c) 当然,有是 default 的话,也少了 bad credit 的影响。但是华人在买房之时都会有足够的打算,出现 default 的机会很少; d )除非你的 credit score 很低而收入又不足为道,用了你的就满足不了贷款条件。 e )又除非是高贷款率的投资房产为了保护另外一方的 credit 的考虑。
就算是在 Community Property States ,我认为也是双方的名字在 title 上比较合理和有利。因为这避免了发生单方面卖掉物业或者再贷款出来( credit line )用掉的机会。正常来说不会,因为 lender 都会要求夫妇双方签字。但是也会有人为错误发生的可能。要是双方名字都在 title ,谁都会要求双方签字才接受。
