中国政府依据《联合国海洋法公约》,对南海的海岛和礁石的解释定义



我们首先必须搞明白, 中国在南沙岛礁建设的主权争端的国际法依据。作为《联合国海洋公约》的缔约国,我国对南沙岛礁的领土、领海和领空主张是有依据的。


按照《联合国海洋法公约》,我方对南沙岛礁的主权领土问题的解释是,所有明礁,我国都拥有无可争议的主权,它们无疑可以拥有12海里领海和领空。在目前正在扩建的岛礁中,有多个是有常年露出水面的明礁的,它们拥有领海领空,是不应该有疑问的。同时,按照《公约》的规定,我国正在扩建的岛礁中另一部分是在低潮时有露出水面的高地,这些不应作为领海的起讫点……但《公约》的条文中又提到,”在低潮高地上筑有永久高于海平面的灯塔或类似设施”的除外,而中国目前扩建的岛礁中恰恰就有这样的设施。再结合我国的国内法,我国也是可以主张这里的领海领空权益的。
