REMINDER! Filing Window for H-1B Visas for FY 2007 Begins on April 1, 2006 By: Nicole C. Those alien workers who are seeking H-1B visas for the first time, specifically those working in organizations/corporations not otherwise exempt from the cap, are not able to work using an H-1B visa until October 1, 2006. All alien beneficiaries, other than those working for universities, not-for-profit research organizations and government research organizations, must be counted against the Congressionally mandated H-1B cap of 65,000 visas permitted each year. Once an alien worker has been counted against this cap, they may continue to work in H-1B status for the next six years. Last year, the H-1B cap was reached on August 10, 2005, two months before the fiscal year 2006 even began. Thus, it is important that employers file their petitions as soon as possible after the filing window opens to ensure that they are able to secure a petition approval for their alien employees.
