Specifically the service answered a question that asked about the effect of filing multiple I-140s for beneficiaries that qualify for more than one EB category, and whether an approved I-140 application needed to be withdrawn in order to apply for a different category. USCIS Texas Service Center spokesperson stated the following: 1. Multiple I-140s can be filed for the same beneficiary. 2. More than one I-140 can be filed based on the same approved labor certification. 3. One I-140 need not be withdrawn for adjudication of a second I-140. 4. If another I-140 is filed, copies of the approved I-140 for a different classification based on the same labor certification should be ted. According to this answer, it appears that I-140 filings based on multiple classifications remain a potentially useful tactic for clients during a time of long visa waits and erratic changes in priority dates among the various categories.
