By: Beth Robertie, Esq. It has recently been announced that the Washington D.C. district office will be a pilot site for a new EAD processing program. Although it is currently unclear when the new program will be enacted, it is important to understand the changes that will be taking place. The pilot program will make two major changes to the current EAD system – no longer will I-765s be filed with the local office, and iEADs will no longer be issued. Once the pilot program begins, the Washington district office will no longer produce EAD cards for any I-765 applications filed on or after the start date. For applications field before that date, the card will be issued by Washington. Non-interim EAD cards (applications for initial or renewal EAD cards) On the date that the pilot begins, the Washington office will, for the next 30 days, forward any locally filed I-765 application to the appropriate service center. Any applications filed after the 30-day period will be rejected with instructions to file the I-765 application with the appropriate service center. Interim EAD cards A beneficiary may still make an InfoPass appointment with the Washington office if more than 90 days have passed since the I-765 application was filed and the card has not been received. When the beneficiary goes to the office, the staff there staff will research the reason why the card had not yet been received. For example, if the card was not produced because the biometrics were not taken at the ASC, their staff will provide an appointment for the alien to appear at the ASC. Their staff will take the necessary steps to contact the service center, if necessary, to get the card to production. Under no circumstances will their office issue an interim employment authorization card. All production of the cards will be done at the card production facility, and the card will be mailed to the applicant. It will take approximately 10 days from the time the card gets into production for the beneficiary to receive it through the mail. While USCIS has designed this program to force themselves to issue EAD cards within the 90 day window that is required, it remains to be seen how effective the new program will be. www.fan-law.com (Chinese) www.fanuslaw.com (English) CALIFORNIA : Fan, Fitzpatrick & Thompson, LLP. 370 E.
