做了十多年的诉讼律师,我对此深信不疑。
有这么一位律师,在联邦法庭向法官申请Reschedule下一次的听证,因为他要去赴总统的宴会。“I have to go because it's the President.” 本来法官是要准他的假的,没想到这位律师又自作聪明地补了一句:”I am sure you'll understand, Your Honor. After all, he's your boss too!”
案子进行到中午,法官宣布休庭吃饭。纽约的律师们来到当地唯一的一家高档餐馆,围桌而坐,看着上面只印有 “Breakfast," "Lunch," "Dinner" 三道菜的菜单,刚刚准备点 "Lunch" 的时候,突然发现这个案子的法官居然和本案的原告律师以及一名陪审员在共进午餐!这还得了?纽约的律师们饭也不吃了,赶紧回旅店,写Motion,要求 new trial.
下午重新开庭的时候,法官看了两眼我们呈上去的Motion,不紧不慢地说:"The New York attorneys, you don't understand. This is a small town, everybody knows everybody. Just because we are friendly, doesn't mean that we are partial.”
首先,the claim that “Hillary freed a rapist” is false. 希拉里并没有Free那个嫌疑犯。She entered a plea deal to get him a lesser charge. 那个嫌犯最后的罪名是 “unlawful fondling of a child under the age of 14,” (非法猥亵不满14岁的儿童)instead of rape (强奸)。
而希拉里能够将那名嫌犯的罪名从强奸降下来,完全是因为控方缺失了指控强奸所需要的key evidence – 嫌犯的精子。控方最初拒绝将受害人的内裤提供给辩方律师, which was really absurd as that was The Key Evidence of this case. 后来希拉里Requested a Court order. 在法庭的强制下控方才交给辩方这一关键证据—— 受害人的内裤,但是这条内裤的中间部分被剪掉了。控方的解释是,他们将中间的部分剪掉拿给他们自己的专家验证之后丢掉了。希拉里将这个中间有一个洞的内裤拿到辩方的专家那里,专家认为在现有的内裤材料上不能肯定嫌犯的精子在上面。至此,支持强奸的唯一证据就只有那个受害人的口供。
希拉里的批判者宣称她强迫受害人接受心理测试。受害人自己也站出来肯定这种说法。然而法庭记录原件显示的是,希拉里要求法庭为受害人安排心理测试,但是她的要求被拒绝了。这一点是好几个看过法庭记录的记者和律师都确认了的。Hillary’s side of the story was: she was told by the suspect that the girl had a history of fabricating like stories. 作为那个suspect的律师,希拉里在得到这样的信息之后要求对受害人进行心理测试是很正常的。如果她不做这样的要求,我会认为她没有尽到责任。受害人自己在此案结束不久接受采访时也承认她并没有被强迫接受这一测试,但是后来在川普找到她时她又提供了完全不同的说法。受害人在这一点上的前后矛盾也是被很多媒体披露了的。
Hillary's job was to protect the suspect. The prosecutor's job was to protect the victim. The court's job was to make decisions based on both sides' facts and arguments. Hillary did her job. The Court did its job. The prosecutor, on the other hand, did not do his job.
当然如果希拉里后来提到这个案子的时候没有不断地发笑, 她也不会如此饱受诟病。She was careless at that interview I have to say. 但是我听完了那段录音,我不认为她在嘲笑受害者。她听上去像是在嘲笑控方在程序和证据上面所出现的荒唐漏洞。就如同一名外科大夫在回忆一次关键的手术时对一些技术细节发出嘲笑。听上去的确有些冷血. 即使是辩护律师,也不应该冷血。但是无论是作为律师还是作为医生,我都不认为我们应该让同情心妨碍判断力。
同样我也不认为应该用逃税的事来攻击川普 :)。 如果税法规定了 business loss can be used to deduct tax, then a billionaire should be allowed to use that. 我们不能歧视有钱人。税法这样规定自有它的道理。如今被一个千万富翁利用了,明年的税法也许就会有所改进了。
